Neighbor Shoots Burglary Suspect Fleeing Merry Hills Home

Two Briarcliff men were charged in the Wednesday morning incident.

A Merry Hills man stopped a burglary last week after he confronted two men fleeing his neighbor's home and shot one of them in the leg, DeKalb County police said.

The man told police he confronted the men after they broke into a home in the 1300 block of Carolyn Drive at about 11:40 a.m. Wednesday, according to the police report.

He said he first fired a warning shot into the air because one of the suspects would not get on the ground and "acted like he was going to leave the scene," the report said. When the suspect approached him, the man said he fired what he thought was another warning shot only to realize he'd hit the man in the leg.

A responding officer discovered the wounded suspect on the ground when he arrived.

"The white [man] shot me!" the suspect yelled repeatedly.

The two men arrested and charged with burglary are Nicholas Lewis, 21, and Nicholas Gallaspy, 19, both of North Druid Hills, according to the police report. Gallaspy, who was shot, was taken to Atlanta Medical Center for treatment.

A laptop computer and an iPad taken from the home were returned to the burglary victim.

I do not like the attitude of people who second guess the victim in this case. I doubt most of you, if any and me included, could keep perfectly under control. Until you have had his experience I would refrain from judgement. The only mistake he made was letting this guy live. He now has to worry about "street justice" from the perp or his "peeps". And they have all the advantages. Chief of which is the utter lack of faith you people have in your neighbor. Buddy, next time send that bullet my way, I'll take that chance and live with it if it helps you defend our neighborhood.

I am the shooter. The report is not totally accurate. I did not fire any shots into the air. I shot 2 warning shots into the soft dirt near his feet as he approached me. I was within my right to use deadly force when he then attacked me with his left arm in front and his right arm behind his back reaching for...I knew not what. I pushed him away, creating distance, just like I was trained, and shot him in the leg. I am in agreement that gun owners should be trained and I am. Thank God we live in a country where we can still protect ourselves and our neighbors. Pray the fools do not infringe upon that right.

Thank you Jan...these guys robbed my house a week prior to your encounter with them. Unfortunately, police told me they had already sold everything stolen from me, so I cannot recoup my losses. On the other hand, it makes me feel better and more secure that these felons got caught...and I was happy to hear that one of them was injured in the process. Hopefully that is a deterrent for future robberies.
